Expert Witness

Expert advice is often needed in connection with a variety of building disputes whether it is between a client and a contractor or a landlord and tenant they include:

  • Construction contracts
  • Quality and costs of building works
  • Timing of building works
  • Dilapidations
  • Party Wall and boundary disputes
  • Building surveys
  • Leasehold and Freehold enfranchisement
  • Specifications
  • Landlord and tenant issues

These are areas in which an Expert Witness report may be necessary to resolve the disputes either by court, arbitration or an alternative resolution.

We work closely with solicitors on cases where we will inspect the property and prepare a targeted preliminary report detailing the strengths and weaknesses of a dispute. More often than not, a good, professionally presented preliminary report can lead to a quicker and more economic resolution avoiding the need for court action. In cases where the matter does proceed to court then Northwood Carter can collate evidence and prepare a full Expert Witness Report in compliance with the Civil Procedure Rules (CPC) and the RICS practice statement and guidance note and present it to the courts.
